Rule 1.-This Prakas sets out the regulation and procedure for accelerating the Recognition Registration of Industrial Designs under Industrial Designs Cooperation related to Industrial Designs applications with China National Intellectual Property Administration in Cambodia.

Rule 2.- Applicants who have already filed for Industrial Designs application at the Ministry of Industry, Science, Technology and Innovation can apply for the accelerate recognition registration of Industrial Designs with the results of the Industrial Designs Examination conducted by the China Intellectual Property Administration.

Rule 3.- The Application forms for accelerating recognition of industrial designs can be made in accordance with the following conditions: 1- Industrial Designs application must be declared a priority document under the Paris Convention on the Protection of Industrial Property on the basis of the Chinese Industrial Designs application form or 2- Industrial Designs application based on the same as Industrial Designs application for declaration of priority under the Paris Convention on the Protection of Industrial Property on the basis of the application of the China National Intellectual Property Administration, including Industrial Designs application under The Hague Agreement deals with the registration of international Industrial Designs.

Rule 4.- The Application forms must complete the form as stated in Annex 1 (IDRP) and attach the following documents: 1. The application form must fill in the data: A - Title of Industrial Designs B - Filling Date C - Application Number D - Name of the Applicant E-Application form related to China National Intellectual Property Administration. 2- The application must be attached by the following documents: A. A copy of the Industrial Designs Bulletin with the Application form of Industrial Designs that submitted at the National Intellectual Property Administration of China. B. Translate the Product Specification and describe the Appearance and Shape of the Industrial Designs that published in the Chinese Industrial Designs Bulletin to English and Khmer within three (3) months from the date of requesting accelerate the recognition registration of industrial designs.

Rule 5.- The Accelerate of recognition registration of Industrial Designs under Industrial Designs Cooperation with China National Intellectual Property Administration shall be applied at the Industrial Property Department of the General Department of Industry of the Ministry of Industry, 3 Science, Technology and Innovation. Rule 6.- After receiving the application form, the officer of Industrial Property Department shall perform the following: 1-Conducting Formality Check 2-Examine the Application form with the registered list of Industrial Designs and check if Industrial Designs are contrary to public order or morality. 3-In case that the Industrial Designs can be registered, the officer of Industrial Property Department shall accelerate the registration process for the applicant. Rule 7.- The request for an accelerated of Chinese Recognition Registration of Industrial Designs in Cambodia under Industrial Designs Cooperation between the Ministry of Industry, Science, Technology & Innovation and China National Intellectual Property Administration under this Prakas is free of charge.
